While no one at the U.S. Attorneys office in New York would comment, Access Hollywood has learned that Follieri, who was slated to learn his fate on September 5, stemming from 12 counts, including wire fraud and money laundering, asked that a grand jury's preliminary hearing be postponed another week until September 12.

According to a law enforcement source, on September 12, three possible scenarios can take place -- a grand jury will decide whether or not to indict him; he can plead guilty; or the case will again be pushed back.
